Size Stream's MeThreeSixty Privacy Policy

This Privacy Policy describes how we collect, use, and disclose personal information through our MeThreeSixty app. It describes certain rights that you may have with respect to this personal information and describes how you may exercise those rights. In this Privacy Policy, “we,” “our,” and “us” refer to Size Stream, LLC, a limited liability company organized under the laws of Delaware, USA, and “you” and “your” refer to individuals who use our me-three-sixty app, which we refer to as the “App.”

In this Privacy Policy, “personal information” generally means any information that can be used to identify a person or that relates to a person who we can identify by referring to other information. However, when this privacy policy talks about personal information, we intend to include any information which would be considered to be “personal information” or “personal data” under laws to which we are subject.

We may update this Privacy Policy from time to time if, for example, we change our policies or practices related to personal information or if there is a change in the laws to which we are subject. When we do so, we will revise the “last updated” date listed above.

NOTICE TO INDIVIDUALS IN EUROPE

We process the personal information you provide to us in the United States. By providing your Personal Information to us, you consent to the transfer of your information to the United States and the processing of that information in the United States. Although the United States has entered into data privacy frameworks with the EU, the UK and Switzerland, we do not currently participate in those frameworks. Nevertheless, we are committed to abiding by the privacy principles described by the General Data Protection Regulation, and we have specified methods under which you may enforce your rights. However, the laws of the United States may not respect such principles. You may withdraw your consent to our use of your personal information at any time by ceasing to use the App and emailing us at gdpr@sizestream.com.

INFORMATION WE COLLECT AND USE

If you use the App, then it will collect the following types of personal information about you:

Your name
Your email address
Your phone number
Your gender
Your birthday
Your height
Your weight
Body scan data, described below

“Body Scan data” means data about your body shape from photographs taken by the App. We do not store the photographs themselves once we have processed them to create body scan data, although the photographs may remain on your cell phone available in your camera application or other app which you use to store photos.

HOW WE USE YOUR PERSONAL INFORMATION

We use your personal information mainly to provide the App’s functionality to you. We may use your personal information to improve the App and for the research and development of new services. We may share your personal information with our affiliates and our development partners for these purposes but require them to protect your personal information in a manner consistent with this Privacy Policy.

SHARING AND SELLING OF YOUR INFORMATION

We will share your personal information with third parties only in the ways that are described in this Privacy Policy. We share personal information under the following circumstances:

We may provide personal information to companies that assist us in providing and supporting the App, such as a data center provider or a customer service provider. These companies are authorized to use your personal information only as necessary to support the App and to assist with supporting users of the App.
With your consent, or at your direction, we may transfer your personal information to one or more third party companies for the purpose of allowing them to provide or offer services to you. We will ask for your permission before any such transfer and that request will identify the third party. We may receive compensation from the third party for referring you to them and, if so, we will inform you at the time we ask for your consent.
We may share your personal information in response to subpoenas, court orders, and other legal processes or governmental requests, or to establish or exercise our legal rights or defend against legal claims.
We may share personal information to investigate, prevent, or take action regarding illegal activities, suspected fraud, protecting and defending the rights or property of Size Stream, its Services and its users, violations of Size Stream terms of use, or as otherwise required by law.
If we are acquired by or merge with another company, we may share personal information regarding our users with that company. If that other company has a privacy policy which is materially different than ours, then we will use reasonable efforts to notify you before your personal information is shared with that other company.

YOUR RIGHTS RELATING TO YOUR INFORMATION

You have certain rights relating to your personal information, subject to applicable laws. Depending on the applicable laws and, in particular, if you are located in the European Economic Area, these rights may include:

To access your personal information held by us (right to access)
To rectify inaccurate personal information and, taking into account the purpose of processing the personal information, ensure it is complete (right to rectification)
To erase/delete your personal information, to the extent permitted by applicable data protection laws (right to erasure; right to be forgotten). In some instances, we may not be able to delete some or all your information in order to comply with applicable laws. We may retain de-identified data.
To restrict our processing of your personal information, to the extent permitted by law (right to restriction of processing).
To transfer your personal information to another controller, to the extent possible (right to data portability)
To object to any processing of your personal information carried out on the basis of our legitimate interests (right to object).
Not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects (“Automated Decision-Making”). We do not engage in any Automated Decision-Making.
The right to withdraw your consent to any collection, processing or sharing of your personal information, without affecting the lawfulness of the processing based on such consent before its withdrawal.

SECURITY

We take reasonable technical, administrative and physical measures to protect the security of your personal information from unauthorized use, disclosure and alteration. Among other things, we provide information and training to all employees who have access to personal information we maintain.

CHILDREN'S PRIVACY

The App is not intended for use by minors under the age of 13. If you believe that it has been used by somebody under age 13, please inform us using the contact information shown below.

NOTICES TO CALIFORNIA CONSUMERS

In the 12 months before the Effective Date written above, we have collected the following types of personal information using the App:

Email Addresses
Birth Dates
Biometric Data

This information is collected directly from users of the App. We collect this information to provide the App and to provide meaningful information to users of the App.

In the preceding twelve months, we have not sold or shared any personal information with third parties.

We do not sell or share personal information about people under the age of 13. If a person is between 13 and 15 years old, we only sell or share personal information with their express “opt-in” consent, which we obtain when they first register in the App.

In the last twelve months, we have provided Names, Email Addresses, Birth Dates and information concerning our users’ health (specifically scan data) to our service providers so they may assist us in providing the App.

Other than scan data, we do not use or disclose sensitive personal information (as such term is defined in the California Consumer Privacy Act, as amended).

California Consumers have the following rights:

The right to know what personal information we have collected about you, including the categories of personal information, the sources from which this personal information is collected, our business or commercial purposes for collecting, selling or sharing personal information, the types of third parties to whom we disclose personal information and the specific pieces of personal information we have collected about them
The right to delete personal information we have collected about them, subject to certain exceptions
The right to correct inaccurate personal information we maintain
The right to opt-out of any sale or sharing of their personal information by us
The right not to receive discriminatory treatment for the exercise of their privacy rights described in the section.

We may ask you to verify your account by asking for the email address or phone number we have on file for you. You may authorize a third party to interact with us on your behalf. In this case, please identify the agent in an email sent to us.
