PRIVACY POLICY
Size Stream's MeThreeSixty App

​This MeThreeSixty Privacy Policy describes how we collect, use, and disclose personal information through our MeThreeSixty app (our “App”) and describes certain rights that you may have with respect to your personal information and how you may exercise those rights. For information on our data policies and practices outside of our App, please see the Size Stream Privacy Policy.
​In this MeThreeSixty Privacy Policy, “we”, “our”, and “us” refer to Size Stream, LLC, a limited liability company organized under the laws of Delaware, USA, and “you” and “your” refer to individuals who use our App.

​​In this MeThreeSixty Privacy Policy, “personal information” generally means any information that can be used to identify a person or that relates to a person who we can identify by referring to other information. However, when this Privacy Policy talks about personal information, we intend to include any information which would be considered to be “personal information” or “personal data” under laws to which we are subject.
​We may update this MeThreeSixty Privacy Policy from time to time if, for example, we change our policies or practices related to personal information or if there is a change in the laws to which we are subject. When we do so, we will revise the “last updated” date listed below.

INFORMATION WE COLLECT AND USE

If you use the App, then it will collect the following types of personal information about you:

Body Scan Data, described below
We use a mathematical model of the contours of a human body. This model computes your body shape from photographs of your body that you take within the App. Such data collected from you through this process is “Body Scan Data”. We do not store the photographs themselves once we have processed them to create Body Scan Data, although the photographs may remain on your cell phone available in your camera application or other app which you use to store photos.
​You many also voluntarily provide us with personal information (including health information, at your discretion) in response to surveys and other information requests through the App.

HOW WE USE YOUR PERSONAL INFORMATION
We use your personal information to provide the App’s functionality to you. We may use your personal information to improve the App and to develop new services. We may share your personal information with our affiliates and our development partners for these purposes but require them to protect your personal information in a manner consistent with this MeThreeSixty Privacy Policy.
We may use your personal information to create anonymized and/or aggregated information that does not include your personal information.

Subject to your right to opt-out of targeted advertising, we may use your personal information to provide you with targeted advertising based on your engagement with our App.

DISCLOSURE OF YOUR PERSONAL INFORMATION
We will share your personal information with third parties only in the ways that are described in this MeThreeSixty Privacy Policy. We share personal information under the following circumstances:

We may provide personal information to companies that assist us in providing and supporting the App, such as a data center provider or a customer service provider. These companies are authorized to use your personal information only as necessary to support the App and to assist with supporting users of the App.

With your consent, or at your direction, we may transfer your personal information to one or more third party companies for the purpose of allowing them to provide or offer services to you. We will ask for your permission before any such transfer and that request will identify the third party. We may receive compensation from the third party for referring you to them and, if so, we will inform you at the time we ask for your consent.

We may share your personal information in response to subpoenas, court orders, and other legal processes or governmental requests, or to establish or exercise our legal rights or defend against legal claims.

We may share personal information to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of the App’s terms of use, to protect and defend the rights or property of Size Stream or our users, or as otherwise required by law.

If we are acquired by or merge with another company, we may share personal information regarding our users with that company. If that other company has a privacy policy which is materially different than ours, then we will use reasonable efforts to notify you before your personal information is shared with that other company.

YOUR RIGHTS RELATING TO YOUR INFORMATION

You have certain rights relating to your personal information, subject to applicable laws. Depending on the applicable laws and, in particular, if you are located in the European Economic Area, these rights may include:

To erase/delete your personal information, to the extent permitted by applicable data protection laws (right to erasure; right to be forgotten). In some instances, we may not be able to delete some or all your information in order to comply with applicable laws. We may retain de-identified data.

To transfer your personal information to another controller, to the extent possible (right to data portability)

To object to any processing of your personal information carried out on the basis of our legitimate interests (right to object).

Not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects (“Automated Decision-Making”). We do not engage in any Automated Decision-Making.

The right to withdraw your consent to any collection, processing or sharing of your personal information, without affecting the lawfulness of the processing based on such consent before its withdrawal.
​You can also control whether we use your personal information for targeted advertising by turning off the targeted advertising setting in your account settings.
To exercise your rights, please contact us using the information in the Contact Information section of this MeThreeSixty Privacy Policy. We try to respond to all legitimate requests within one month and will contact you if we need additional information from you in order to honor your request.

SECURITY

​We take reasonable technical, administrative and physical measures to protect the security of your personal information from unauthorized use, disclosure and alteration. Among other things, we provide information and training to all employees who have access to personal information we maintain.

NOTICE TO CALIFORNIA RESIDENTS

In the past 12 months, we have not sold or shared any personal information with third parties within the definition of the California Consumer Privacy Act of 2018 (the “CCPA”), as amended by the California Privacy Rights Act of 2020 (the “CPRA”) (together, the “California Privacy Laws”). In the past 12 months, we may have collected the following types of personal information from users of our Services, if voluntarily provided:

California Customer Records personal information, as listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) (e.g., names, physical characteristics or descriptions, addresses, and telephone numbers).

This information is collected directly from you or indirectly through automatic technologies. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes than provided for in this MeThreeSixty Privacy Policy without providing you notice. In the preceding twelve months, we have not sold or shared any personal information with third parties.
Other than Body Scan Data, we do not use or disclose sensitive personal information (as such term is defined in the California Privacy Laws).

The right to know what personal information we have collected about you, including the categories of personal information, the sources from which this personal information is collected, our business or commercial purposes for collecting, selling or sharing personal information, the types of third parties to whom we disclose personal information and the specific pieces of personal information we have collected about them;

We may ask you to verify your account by asking for the email address or phone number we have on file for you. You may authorize a third party to interact with us on your behalf. CONSUMER HEALTH DATA PRIVACY POLICY
​This Consumer Health Data Privacy Notice (this “Health Data Notice”) provides certain information that we are required to provide under the Washington My Health My Data Act (the “MHMDA”), the Nevada Health Data Privacy Act (the “NHDPA”), or other applicable state consumer health privacy law in connection with our App. This Health Data Notice only applies to personal information defined as “consumer health data” ” under laws to which we are subject.

Categories of Consumer Health Data We Collect and the Purposes for Which this Data is Collected
As described in the Information We Collect and Use section of this MeThreeSixty Privacy Policy, our App collects your Body Scan Data. We collect Body Scan Data to provide you with our App and related services and, either with your consent or at your direction, to provide Body Scan Data to third parties on your behalf.

​We also collect health data such as health-related conditions, body measurements derived from Body Scan Data, weight loss status, medication treatment, or other information that may be used to infer or derive data related to health information (“Other Health Information”) that you provide to us when you voluntarily respond to surveys and otherwise communicate with us . We collect Other Health Information in order to: (a) provide better services through our App to you, including by providing you with relevant advertising and content; and (b) have the ability to provide, either with your consent or at your direction, Other Health Information to third parties on your behalf.
Body Scan Data and Other Health Information are also collected to learn more about our users by analyzing this data on an anonymized basis.

2. Categories of Sources from Which the Consumer Health Data is Collected

We collect Body Scan Data directly from you, the scan subject, when you use our App, and we collect Other Health Information from you when you voluntarily share it with us.

3. Categories of Consumer Health Data that We Share
​
With your consent or at your direction, we will share Body Scan Data, including body measurements derived from your Body Scan Data, with third parties on your behalf.

​We will not share Other Health Information with another party without your written consent.
​
4. Categories of Third Parties with Whom We Share Consumer Health Data
​
We share consumer health data only with those third parties (including our affiliates) to whom a user has given explicit consent. Such third parties consist of:

Service providers. Vendors or agents (“processors”) working on our behalf may access consumer health data for the purposes described in this Health Data Notice.

Business partners. We may share consumer health data with other companies, for example, where you use a service that is cobranded and jointly operated with another company, or where you use our services to interact with another company.

Parties to a corporate transaction. We may disclose consumer health data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.

Government agencies. As described in the Disclosure of Your Personal Information section of this MeThreeSixty Privacy Policy, we may disclose consumer health information to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.

Other third parties. In certain circumstances, it may be necessary to provide consumer health data to other third parties, for example, to comply with the law or to protect our rights or those of our customers.
5. How Consumers May Exercise and Appeal their Consumer Health Data Rights

If you are covered by MHMDA, the NHDPA, or other applicable consumer health privacy law, then you may have certain rights with respect to consumer health data, including rights to access, delete, or withdraw consent relating to such data, subject to certain exceptions. You can request to exercise such rights by emailing us at privacy@sizestream.com. You can also control whether we use your consumer health data for targeted advertising by turning off the targeted advertising setting in your account settings. In order to process your request, we may require that you provide additional information to verify that you are who you claim to be.
If your request to exercise a right is denied, you may appeal that decision by emailing us at privacy@sizestream.com. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint, the Nevada State Attorney General at https://ag.nv.gov/complaints/file_complaint/, or other regulatory authority as applicable.

NOTICE TO INDIVIDUALS OUTSIDE OF THE U.S.
​Notice to individuals outside of the U.S. (including EU and Switzerland where Size Stream is the controller of your data): We process the personal information you provide to us in the United States. By providing your Personal Information to us, you consent to the transfer of your information to the United States and the processing of that information in the United States. Although the United States has entered into data privacy frameworks with the EU, the UK and Switzerland, we do not currently participate in those frameworks. Nevertheless, we are committed to abiding by the privacy principles described by the General Data Protection Regulation, and we have specified methods under which you may enforce your rights. However, the laws of the United States may not respect such principles. You may withdraw your consent to our use of your personal information at any time by ceasing to use the App and emailing us at privacy@sizestream.com.
